The warrantor, herein after referring to Chemical Specialties, Inc., extends this Limited Warranty to "Original Consumer-Purchasers" of Preserveq and Preserveq Plusq pressure-treated wood products in the United States and Canada. Original Consumer-Purchasers are defined herein to mean the owners of record of the residential properly first using It for residential purposes immediately following installation of the warranted wood. This warranty is good from the date of purchase for as long as you own your property on which your new Preserveq or Preserveq Plusq residential structures are built. This warranty is not transferable. Preserveq and Preserveq Plusq pressure-treated wood products, when used in conjunction with a residential structure, are warranted for the lifetime of the original Consumer-Purchaser against damage by fungal decay or termite infestation that makes the wood structurally unfit for the application for which it was used. Preserveq Plusq is additionally warranted to pass the ASTM D4446 swellometer test when compared to CCA-treated or untreated wood of the same species exposed to comparable use conditions. Each piece of Preserve wood covered by this warranty shall have been pressure treated with ACQq preservative, and each piece of Preserveq Plusq wood shall have been pressure treated with ACQq preservative and a specially formulated water repellent additive, and either must bear the logo of an inspection agency that is sanctioned by the American Lumber Standards Committee. It must also have a Preserveq or Preserveq Plusq Lifetime Limited Warranty end tag attached to one end or each piece of wood. The warrantor, with in 60 days of validation of claim under this warranty, will arrange to exchange the damaged Preserveq or PreserveqPlusq pressure-treated wood for new wood of the same type. Original Consumer-Purchaser must present, to the warrantor, the original invoice showing date and specified amount of Preserveq or PreserveqPlusq pressure-treated wood purchased and end tags to equal the amount of wood claimed to be damaged. When making any warranty claim, you may be required to send photographs and sections of damaged wood. In addition, the warrantor reserves the right to have a representative inspect and test all wood claimed 10 be damaged. Failure to use this product In accordance with instructions or restrictions printed on the end tag voids this warranty.
1. Preserveq or PreserveqPlusq pressure-treated wood used in foundation systems, used in salt water immersion applications (except residential Freshwater decks) used for any non-residential applications, or damage resulting from any cause other than fungal decay or termites. 2. Damages caused by natural change in physical appearance of wood beyond the control of the product. 3. Costs associated with the delivery installation, removal or reinstallation of Preserveq or PreserveqPlusq pressure-treated wood products. 4. Any incidental or consequential damages claimed to be a result of failure of Preserveq or PreserveqPlusq pressure- treated wood. For western species of wood, this warranty Is void unless all cuts and bore holes are coated during construction in accordance with American Wood-Preservers' Association Standard M4 using a copper naphthenate preservative solution containing a minimum of 1% metallic copper. The obligation of the warrantor under this warranty is limited to replacement of lumber in accordance with the terms of this warranty. There a re no warranties offered by the warrantor other than those described herein. Nothing in this warranty shall affect customary duration, or create additional implied warranties. Some state and local laws vary wiU1 regard to duration of implied warranties and limitations of incidental or con- sequential damages contained in such implied warranties. in any event the warrantor will comply with the laws of the state in which a limited warranty is validated. Your Preserveq or Preserveq Plusq pressure - treated wood are not maintenance-free products. Over lime, foot traffic, weathering and the sun's ultra-violet rays will affect the water repellency and the wood's surface in general. To help maximize surface protection and to keep your wood looking better longer, we recommend that a surface applied water repellent be applied every two years.
